Terms.

What I offer

Build. A custom website built from scratch for $750 (one-time). Includes up to 6 pages, custom design, responsive layouts, Cloudflare hosting setup, SSL + DNS, contact and booking forms, and two rounds of revisions. About a week from kickoff to launch.

Care. Ongoing hosting and maintenance for $49/month, or $539/year (one month free). Includes uptime monitoring, SSL and DNS management, unlimited content updates, security patches, form monitoring, minor design refinements, and email + phone support.

Payment

Builds are paid in two installments:

• 50% deposit ($375) invoiced at engagement, due before further work continues
• 50% balance ($375) invoiced and due at launch

Care plan billing begins on launch day. Monthly Care renews on the same date each month; Annual Care renews on the same date each year. Your card on file is charged automatically.

Build refunds

The deposit covers work already in progress and is non-refundable once paid. The balance is due at launch only if the build delivers the agreed scope outlined in your brief. If I fail to deliver agreed scope, the balance is reduced (or refunded from the deposit) for any work not delivered.

Care cancellation

Monthly Care. Cancel anytime. Your site stays hosted through the end of your current billing period, then comes down. No mid-month refunds, no early-termination fees.

Annual Care. Annual subscriptions are paid upfront and non-refundable. You can cancel anytime to stop renewal. Your site stays hosted and maintained through the end of your paid year, then comes down. The annual price includes a discount, so prorated mid-year refunds aren’t offered.

What you get on cancellation

When your Care plan ends (by cancellation or non-payment), I provide you with a static export of your site files (HTML, CSS, JS, and the images you provided) so you can host it elsewhere if you choose. Your site stays live for 30 days after the cancellation date to give you time to migrate.

You don’t receive the source code, build configuration, or internal tooling. Those are TJOnCall IP, covered below.

Ownership

You own: the final live site (HTML, CSS, JS as exported), all content you provided (copy, photos, logos), your domain, and any assets created specifically for your project.

I retain: the underlying design system, code architecture, and build tooling. I also reserve the right to feature your project in my portfolio, case studies, and promotional material (unless you ask me not to), and to reuse general patterns, components, and methods on other projects.

This is industry standard for custom service work. I’m not forbidden from using a similar layout structure on a different client’s site, but your specific design, copy, and brand belong to you.

Service availability

I make best-effort to keep sites online and respond to support requests promptly. Hosting reliability depends on Cloudflare, which generally exceeds 99.9% uptime. I don’t promise a formal SLA. Outages, bugs, and emergencies happen.

If something breaks on my end, I’ll fix it. If something breaks because of a third-party provider (Cloudflare, Cal.com, Web3Forms, etc.), I’ll do what I can, but I’m not liable for their downtime.

Liability

My total liability for any claim arising from your build or Care plan is limited to the total fees you’ve paid in the previous 12 months. I’m not liable for indirect, consequential, or lost-profit damages.

I’m not responsible for: decisions you make based on advice I give; outcomes of your business operations; third-party services or platforms integrated into your site; content you provide or post on your site.

Termination

I reserve the right to refuse service or terminate a Care plan with 30 days’ notice if you repeatedly miss payments, ask me to do something illegal or against my professional judgment, or we can’t work together productively.

You can terminate at any time per the cancellation terms above.

Governing law

These terms are governed by the laws of the State of New Jersey. Any disputes will be resolved in New Jersey state courts.
